Michael Hartnett, CPA

Mike is a founding partner of Encore Partners LLP. He has over 44 years of business experience with 22 years of retail management and 22 years of experience in public accounting, primarily focused in the tax arena.

Prior to forming Encore Partners LLP, Mike was a senior tax manager in the San Diego office of Ernst & Young LLP, helping mid to large sized companies with tax services. At Ernst & Young, Mike specialized in the real estate industry and was a member of the firm’s highly specialized real estate group. Mike served in several leadership roles at EY, including Location Leader for the San Diego office and serving on various committees for National Tax developing both process improvement and technical training programs and teaching education programs for Ernst & Young interns through partners.

At Ernst & Young LLP, Mike focused on providing compliance and consulting services for real estate developers, homebuilders, hotel operators, management companies, Real Estate Investment Trusts (REIT’s), and high net worth individuals. His client focus was on large multi-tiered partnership and corporate real estate organizations with opportunity fund investors operating in multiple states. He is experienced with tax exempt entities, UBTI, dispositions of property, Section 1031 exchanges, multi-state apportionment, debt workouts, bankruptcy reorganizations, and IPO’s.

At Encore Partners LLP, Mike continues to serve clients in the real estate industry, including many of the same clients from his prior position. He has assisted with various multiple commercial property 1031 exchanges and several complex recapitalizations of institutionally held housing operators. Mike has assisted clients with multiple real estate property acquisitions, including multi-tiered structuring with REITs, pro-forma tax modeling, and responding to numerous notices from taxing authorities. In one such case, he assisted a client with an IRS audit where a large deficiency was reversed and reduced to very minimal amount.

Mike has focused on saving his real estate clients significant tax dollars through accelerating depreciation through cost segregation studies and the new Regulations on Repairs and Maintenance and their capitalization policies. In addition, Mike has been involved in the writing of partnership agreements and buy-sell agreements for closely held partnerships. Many entrepreneurs have sought his operational guidance for their business start-ups, he has also provided due diligence studies for potential investments and family legacy planning.

Mike has served as a guest speaker at SDSU each semester for the Real Estate Finance MBA class.

Mike enjoys hiking, running and biking and spending time with his family.
